Police Break Up Fights at Charlotte Beach

Charlotte, N.Y. - Fights involving about 50 youths broke out around 7 o'clock Monday night. Police had to clear the area, sending people home.

Police arrested several people.

One deputy was scratched on the face as he was pulled into the fracas. Police say that injury was not serious.

It's still unclear how many people were involved or what exactly started the fight. Witnesses said there were many young children on the beach and when a large scramble suddenly became more like a fight, parents feared the worst.

"I was scared for a minute. I started grabbing everybody...and making sure they moved out of everybody's way,” said beach goer Catrina Davis.

"There was a group of young gentleman running through the parking lot, saying something like someone's getting beat up, and next thing you know there are 20 cops, ambulances, fire trucks," said Kelsey Davis.

Those already at the Rib Fest Monday were allowed to stay in the fenced in area.

This isn't the first time a local venue has shut down because of fights on Memorial Day. Seabreeze made it a policy to close on Memorial Day starting last year after rumors of violence.

LONG BEACH, N.Y. - A Long Island police department says it had to call for backup to quell a beach melee involving hundreds of people that spilled out onto the streets and a nearby bus depot.

Long Beach police say they are investigating the incident. There was no immediate word on arrests.

No injuries were reported.

According to Newsday , 11 Nassau police cars and two Metropolitan Transportation Authority police units assisted with the crowd control on Monday evening.

Police say a series of fights erupted on the beach just before it closed at 6 p.m. and continued for several hours.  It was not clear whether the fights involved the same group of young people or different groups.

Police say the situation was brought under control by 9 p.m.  MTA spokesman Sam Zambuto said the bus depot was cleared by 9:30 p.m.

SAN JOSE (CBS SF) – At least two people were stabbed and hospitalized, and three others injured after a massive brawl involving dozens of people broke out in the parking lot of a McDonald’s near San Jose State University.

The fight happened around 10 p.m. about a block away from the university on the corner of San Jose and Third Streets, and just hours after a free downtown concert let out.

Police said a small crowd started gathering before it quickly turned into a mob of more than 100 people, many of who began screaming, yelling, and throwing punches when a fight broke out.

Witnesses said the friends of one of the stabbing victims literally dragged him into a car and tried fleeing the scene, but police stopped them before they could get away.

Those who work downtown said word is getting out that San Jose is laying off police officers, leading to a spike in crime.

“A lot of things come from a lot of out-of-towners,” said restaurant manager George Bracamonte. “We talk to people, a lot of out-of-towners and I guess kind of an opinion I’ve heard was maybe a lack of resources in the police department, why the out-of-towners are coming here and doing what they do. As they call it get ‘hifey’ and crazy and disrespect the streets.”


The condition of each of the victims is not currently known, but there are reports that a 17-year-old male and a 19-year-old male suffered non-life-threatening stab wounds.

Three others were treated and released for their injuries.

It’s not known what started the brawl, which witnesses said was so big it looked like a riot.

Police spokesman Jose Garcia said race may have been a motive in the brawl, and that about half the group was Latino, the other half black.

“Some of the individuals who were involved in this disturbance are being uncooperative with investigators, as well as potential witnesses who were not being very cooperative. So that makes it very difficult for us to determine what occurred and the motive,” he told KCBS.

Witnesses told CBS5 that the brawl was so big it looked like a riot. That kind of behavior isn’t surprising to some. One man, who only identified himself as “Julio,” said the area looks like a “war zone” late at night with groups of youngsters looking for trouble.

“Little 21-year-old gang bangers trying to punk all the older people,” he said. “I feel like you come down here you gotta watch your back.”

This is the second time this year that violence has broken out in a McDonald’s parking lot in San Jose. In March, an 18-year-old man was shot to death outside the McDonald’s near San Jose City College.

IHOP shooter found not guilty on all counts(CA)

Sutter County jurors on Wednesday found a Fresno man not guilty on all counts in the March shooting of Obadiah Samuel Mitchell at the Yuba City IHOP restaurant.

Jessie Hipolito Pena, 44, was charged with attempting to murder Mitchell after confronting him inside the restaurant for using profanity.

Jurors could have found Pena guilty of the lesser charge of attempted voluntary manslaughter but also rejected that option.

The jury forewoman declined comment as she left the courtroom, but another member of the panel, Ashley Yetter of Yuba City, said jurors felt evidence was insufficient to indicate whether Pena acted in self-defense or not.

Pena said he saw a metal object in Mitchell's hand, telling police at first he thought it was a gun. Later, he said it might have been a knife or an antenna. He fired once, hitting Mitchell in the chest.

"I had nothing in my hand. I don't know what to say," Mitchell said as he sat on steps outside the courthouse.

"There is no justice, no justice at all," Mitchell said.

"It's like Casey Anthony all over again," he said, referring to the Florida woman who was recently found not guilty of murdering her daughter.

After initially confronting Mitchell, Pena went outside to get his gun from his car, then came back inside the restaurant and asked him to step outside.

Mitchell said he thought he was going outside to shake hands with Pena. But Pena fired his 9 mm handgun without saying a word, he said.

Police found a knife from the restaurant near the wounded Mitchell. It will always be a mystery how it got there, Pena's attorney, Antonio R. Alvarez, said after the verdict.

A restaurant security camera showed Mitchell leaving his booth and following Pena outside without picking up a knife from the table.

Alvarez said he thought Pena "came across as reasonable" when he testified Friday.

"I think they believed my client was justified in his actions," Alvarez said.

Pena testified he heard something metallic hit the ground after Mitchell was shot, Alvarez said.

The jury acquitted Pena on two other charges: assault with a gun and battery causing great bodily injury.

"That was a great job the jury did. We're just thankful," said Pena's sister-in-law, Arleen Ramirez of San Bernardino County.

Outside the courthouse, Mitchell, a single father of two girls, said he will have to return to school and find a new line of work because the shooting left him unable to raise his arms above his head. He was a construction worker.

He probably would have died if one of his friends had not kept pressure on the wound before paramedics arrived, Mitchell said.

Surgeons operated on Mitchell to repair his collapsed left lung. He was in the intensive care unit at Rideout Memorial Hospital for several days.

Pena can now go home, get his permit back to carry a concealed gun, "and maybe do this to somebody else," Mitchell said.

"But everything comes full circle. He has to stand before God, not before me," he said.

"I'm just glad it's over. Now I can go on with my life," Mitchell said.

Warrant: McDonald's manager punched customer that had service dog

A Marietta McDonald's manager is accused of punching a mother who brought a service dog and autistic children into the restaurant.

A Cobb County warrant charges Tiffany Denise Allen with simple battery, simple assault fear and disorderly conduct.

According to the warrant, Jennifer Schwenker entered the Marietta McDonald's located at 1291 Bells Ferry Road with her children and service dog on July 12.

Allen, off-duty at the time, became irate that the dog was in the restaurant, the warrant says.

Schwenker explained to Allen the dog's purpose and told the manager the dog was legally allowed to be inside the establishment.

Allen continued to berate Schwenker, following her around the restaurant and even into a bathroom. During the incident, one of Schwenker's twins disappeared. The mother threw her cup to the ground and ran outside to look for her child, the warrant says.

Allen believed the cup was thrown at her and followed the mother into the parking lot, where she is accused of hitting her in the face.

Surveillance video shows several McDonald's employees holding Allen back, according to the warrant.

The warrant for Allen's arrest was signed July 15. She is not listed as having been in custody at the Cobb County jail.

An owner of the McDonald's, who did not want to be named, declined an interview but did say Allen no longer works at the restaurant.

Shooter confirmed dead of self-inflicted gunshot wound

10:50 a.m. update: The Carson City Sheriff's Office is confirming that the shooter is dead of a self-inflicted gunshot wound.

There are reports that three people have died.

10:30 a.m. update: Lt. Rob Van Diest of the Reno Police Department said one person has been confirmed dead.Four victims have been transported to Carson-Tahoe Hospital in Carson City. Three of them are in surgery.

Four victims were transported to Renown Regional Medical Center, two in critical condition and two with less-serious injuries.

10:23 a.m. update: Kurt Althof, public relations manager for Care Flight, said helicopters from all three of their bases — Reno, Truckee and Gardnerville, were called to the scene at 9 a.m.

He said that so far, three shooting victims have been transported to Renown Regional Medical Center, at least two of them in critical condition. The victims transported so far are two women and one man.

A fourth victim was transported to Renown by the East Fork Fire Protection District ambulance out of Gardnerville. That victim’s condition is not known.

10:15 a.m. update: Ralph Swagler, owner of Locals Barbecue in the same strip mall as the IHOP, said he saw a man wearing a red shirt and black shorts pull up outside the IHOP in a blue minivan.

Swagler said the man had a rifle. He shot and killed a man on a motorcycle, then walked inside the IHOP and started shooting.

Swagler said the man spent several minutes there, then walked back outside into the parking lot and began firing into the Locals Barbecue and an H&R Block in the strip mall.

“This happens in third-world countries, not here,” Swagler said.

10:09 a.m. update: There is a report that some of the bullets from the shooting entered the Fandango Casino across the street.

Two more ambulances have taken victims to Renown Regional Medical Center. One was shot in the knee. One ambulance was from East Fork Fire Paramedics in Douglas County and the other was a REMSA ambulance.

He has seen two ambulances and one Care Flight helicopter leave the scene.
