Yes, what he missed, like you (obviously) is that it was dismissed WITHOUT PREJUDICE not because of the merits (the Grand Jury found no issues with the evidence) of the indictment but because of a procedural error. It will likely be overturned on appeal and if not, the case can be refined, and new indictments will be handed down. Aside from that, this was a Bill Clinton activist appointed judge.

She surely must have some knowledge of the law. In fact, I read that she has never had a ruling overturned in the past 30+ years.
You claim (as if it is an absolute fact) that this will be overturned on appeal and if it is filed again, new indictments will be handed down. You also suggest that a conviction is inevitable. Are you a psychic?

The ruling comes amid the push by President Donald Trump's Republican administration to keep Habba as the acting U.S. attorney for New Jersey, a powerful post charged with enforcing federal criminal and civil law. It also comes after the judges questioned the government's moves to keep Habba in place after her interim appointment expired and without her getting Senate confirmation.

Habba said after that hearing in a statement posted to X that she was fighting on behalf of other candidates to be federal prosecutors who have been denied a chance for a Senate hearing.

Messages were left Monday seeking comment from the U.S. attorney's office in New Jersey, Habba’s personal staffer and the Justice Department.

Here is the order dismissing the indictment.  It doesn't say anything about a "failure to properly present the final indictment to the full grand jury."  That's not why the indictment was dismissed.  It was dismissed solely because Halligan was supposedly not properly appointed.

The fact that the appointment of the lawyer was invalid rendered the entire indictment improper.   The invalidated prosecutor herself said that the final indictment was only reviewed by two jurors.  Hmmm.... what happened to the other ten?  Unless the indictment was presented to all, it wasn't presented properly.
