Six people and two Florida corporations were charged in an indictment for their roles in a scheme to distribute illegal dietary supplements, the Department of Justice announced today.
Phillip Braun, 38, of Boca Raton, Florida, Aaron Singerman, 39, of Delray Beach, Florida, Robert DiMaggio, 49, of Henderson, Nevada, Anthony Ventrella, 41, of Boynton Beach, Florida, David Winsauer, 32, of Boca Raton, Florida, and James Boccuzzi, 34, of Parkland, Florida, were charged in a 14-count indictment that was returned by a federal grand jury in Miami, Florida on March 7, 2019, and was unsealed today. The indictment also charged Blackstone Labs and Ventech Labs, two Florida limited liability companies in Palm Beach County, Florida.
The indictment alleges that the defendants sold hundreds of thousands of illegal products, including anabolic steroids, nationwide and internationally, fraudulently representing that those products and pills were high-quality, legal dietary supplements. According to the indictment, the defendants created an illicit manufacturing company and routed sales of illegal products through trusted distributors, knowing that the products were unsafe or could not legally be sold to consumers.
“Fraud by supplement manufacturers and distributors is extremely dangerous for consumers, who rightly assume that a dietary supplement product sold in stores or online will not contain unapproved drugs,” said Assistant Attorney General Jody Hunt for the Department of Justice’s Civil Division. “These products are not safe and that is why we will continue to aggressively pursue and prosecute those who import, manufacture, and distribute dangerous and illegal ingredients for fraudulent purposes.”
“Consumers who use dietary supplements expect those products to be safe. When they contain drugs that are not FDA-approved, the health of the public is put at risk,” said Catherine A. Hermsen, Acting Director, FDA Office of Criminal Investigations. “We will continue to pursue and bring to justice those who place consumers’ health in jeopardy.”
All of the defendants were charged with one count of a conspiracy to defraud consumers and the Food and Drug Administration (FDA) by selling products labeled as dietary supplements that contained unapproved new drugs, illegal steroids, and other ingredients that were hazardous and prohibited by law. The indictment also charges Braun, an owner of Blackstone Labs, and Singerman, a former company owner, with two counts of introducing a product known as Super DMZ RX 2.0, an unapproved new drug, into interstate commerce. The maximum punishment for the conspiracy to defraud is five years in prison and a fine of $250,000 or twice the gross gain or loss from the offense. The maximum punishment for each of the two counts of introducing an unapproved new drug is three years in prison and a fine of $250,000 or twice the gross gain or loss from the offense.
The indictment further charges Braun, Singerman, and six other defendants with one count of a conspiracy to distribute anabolic steroids, which are Schedule III controlled substances under federal law and which may cause kidney failure, liver damage, and other permanent health problems when misused. The indictment alleges that one person suffered serious bodily injury from the use of one of the steroids involved in the conspiracy. The maximum punishment for the conspiracy to distribute controlled substances is 15 years’ imprisonment and a fine of $500,000 or twice the gross gain or loss from the offense.
The indictment additionally charges several defendants in three separate counts of distribution of anabolic steroids and charges Ventrella with one count of possession of an anabolic steroid with the intent to distribute. The maximum punishment for each count of distribution of a controlled substance and for the count of possession of a controlled substance with intent to distribute is 10 years in prison and a fine of $500,000. Finally, Braun and Singerman are each charged with three counts of money laundering. The maximum punishment for each money laundering charge is 10 years in prison and a fine of $250,000 or twice the amount of the property involved in the money laundering transaction.
“Illegal dietary supplements pose a public health risk,” stated U.S. Attorney Fajardo Orshan. “The U.S. Attorney’s Office for the Southern District of Florida and our partners at the Food and Drug Administration strive to ensure that consumers are fully apprised of the ingredients contained in the substances they are ingesting. Those who attempt to circumvent the law and create a public safety hazard will be held accountable.”
This case is being prosecuted by Trial Attorneys Alistair Reader and David Frank of the Department of Justice’s Consumer Protection Branch, with assistance from Daren Grove, Assistant United States Attorney for the Southern District of Florida. The case was investigated by FDA’s Office of Criminal Investigations with assistance from Sarah Hawkins of the Office of Chief Counsel.An indictment merely alleges that crimes have been committed. All defendants are presumed innocent until proven guilty beyond a reasonable doubt.

They are looking for the top people although I'm surprised they got James. However, after me and Vissy got divorced, I did have intentions on moving down to Boca Raton where I would have likely have worked for Aaron in sales and customer service although I would have likely taken up a job at one of the many booming anti-aging clinics or pain management centers otherwise since I would have been paid more. Aaron was paying his customer service reps about 10 bucks an hour at the time which wasn't enough to live in an area like Boca and there was this pain clinic that was going to pay me 40k a year handling their distribution and buying. These centers typically use compounding pharmacies.....keeping meds......ESPECIALLY pain meds would have them under intense scrutiny, and they'd be shut down in 6-12 months likely. There is no need for a buyer. Just decide which compounding center you're going to use, have marketing work out the packaging/labeling, and the relationship details are worked out and over with.

Its not as simple as you think. When you buy compounds, someone has to go through the paperwork and fill out the forms for regulation purposes but I would have also done sales and customer service as well. In any job, you have one designated position but you usually are doing everything else as well...lol. Its not important at this point as I never pursued those paths.

Huh....what a let down of a read. After reading it, I'm really kinda baffled as to why 4 people rolled on them thinking they needed immunity. The total amounts of money PJ and Aaron are each accused of transferring illegally are less than $1M each, and the amount of pills just off memory was 60,000 and 30,000. So putting things in perspective that's 6,000 and 3,000 - 100 caps sized bottles.
I don't know shit about SARMs, but let's say the average dose is two per day and that there was never any repeat orders. That means only 3,000 and 1,500 people were customers....we know it was far less than that as there were surely repeat customers, but out of 300+ Million people in the states only 4,500 unique individual customers maximum.....and they did business overseas too.

If found to be distributing controlled substances then the fine will be $500,000 and may be doubled. If the people charged have no other sources of income then goodbye, savings, houses, cars, gifts, donations, etc. All proceeds from such crimes will be seized. I don't think he is going to see any jail time. Which unfortunately means he will come out broke at the end of the day. That's how the gov't usually "wins" their cases like this. Unlike the defendant, the gov't doesn't have a limited amount of money to spend on attorneys. Instead they just keep grinding along, filing motions, causing the opposing counsel to bill for hours, etc... running up the bill until the opposite side is broke and can't continue. Then they are forced to cope a plea deal that is never in their favor.
I mean in all seriousness, if someone had $3 Million to their name and was facing a case like this, I would encourage them to request 12 months in jail in order for it to be over and not dragging on to the point of bankruptcy.

Watched this . . . I wonder if this was just another attempt at utilizing social media for his own ends. Knew how much the t-shirt company ( allegedly made - 3.1 million ) yet could not remember his own bail? And if you have such significant cash flow, why a bail bondsman? Never commented on his house going to the IRS as was disclosed here and if he remortgaged it to pay off his divorce why would the IRS take a house which had little if any value in it?

Unfortunately, early on the plea deal they offer is usually a terrible one. It's only towards the end when they realize there is no more blood to get out of the stone that they wrangle out a better one. I would have just pled guilty to a lesser charge and got a small stint in the pen in order to save money. 12 months in jail and keep (most of) my money, or burn through all my savings just to end up broke and on probation? Easy answer. I do not know PJs past or what else he has done, but if he has been trouble free, then I don't think he is going to jail. Unless he has had a felony in the last ten years.
Just to give you an example here, my gf's father had an employee that embezzled over $460,000.00 from two of his businesses between 2015 and 2017. Over $300,000 of that money went to casinos due to his gambling habit. He was arrested and charged with Grand Larceny in Second Degree. The evidence is solid and he has confessed. He goes to trial for sentencing in March 2020. He will only get a 5-10 probation time because he has not been in trouble before. He's done this before with other businesses, just got away with it. He will have to pay restitution and fines, but he is currently on disability checks every month so they won't be seeing anything from him in that regards. Unlike PJ who can argue his "crime" was victimless as his customers chose to order from him, this guy's action really did have victims in terms of one business closing and the employees losing their jobs and my gf's dad overall suffering from it. But he won't get any jail time. So I don't think PJ will either.

Did that result in him having a felony conviction or did he invoke his first offender right and after completing his sentencing requirements, was exonerated from the charges or had a pre trial diversion? Because that would keep him from having a felony on his record. Otherwise if he has a felony record, he is a bit more fucked.

The divorce didn't help but honestly PJ's party lifestyle actually drained his fortune along with other unusual things he was doing like going to a doctor for vitamin infusions by drip. He was living way too high on the hog and he made the mistake of thinking the Blackstone train would ride along forever....definitely not doing the business it was in its hey day.
PJ's accountant was also Aaron's accountant at the time. Both of them were making expensive purchases so it hard for PJ to accuse Aaron of misusing funds when he had the exact same issue according to the indictment. He took out 43k for a down payment for his house, then another 112k for a Mercedes, and finally 328k to complete the sale of that house of his. That's why he was also indicted for money laundering...an easy charge to beat but its still there

There are 4-5 prison grades in America, depending on how you look at it -
High Security (I'll include Super Maxes in here), those are for things like high level gang members, terrorists, etc....
Medium - Serious, but not quite reaching the above level.
Low - These can have all sorts of criminals in them, from child molesters, to white collar criminals, to murders, but they are largely non-violent, besides their original crimes, so they aren't seen as a threat.
Low Security Prison Camp - These are the lowest, your white collar fraudsters, tax cheats, etc.... try to wind up here. They are the country clubs of prison, they get good privileges, better jobs, etc..... The camps/dorms are separate from the real prison usually.
