Mental illness is complex and each person should be treated like an individual.  Anyone that is labeled as "retarded" is probably too far gone mentally to be trusted with a firearm.

I believe that ex-felons that served their time and were released should have all their constitutional rights restored.

Interesting idea, the recidivism rate is high for criminals. But it isn't as if the lack of their constitutional  rights prevents them from committing crimes, and the technically paid the price for their offences.

But if I just happened to be at home cleaning up some water damage and a couple of looters entered my house and tried to exit with my computer and my 65 in, high res, TV, .... could I legally shoot them while they are still inside?

(I think I might be searching for a way to shoot a thief .... without suffering remorse and legal consequences!)

There's a difference between someone looting your home and someone looting a grocery store. These people were looting stores. If you're driving by a CVS and you see people looting, you just can't open fire and kill 15 looters without legal repercussions.

If they enter your private home, the rules change (I'm assuming).

So, yeah, I think the laws change once they enter your private home.

Well, legally if you shoot someone that in your home they can sue you for medical and pain and suffering. That is why people say you shoot to kill. IMO I have a few guns, but I couldn't and wouldn't kill anybody over material shit, I have insurance. Now if you going to trying and kill me or my family, that is of course a different story.

MY humble opinion on that matter, I believe people should have a right to have guns, besides anyone that is not a citizen, felons, or people with mental illness. I also believe having guns in schools and colleges is stupid. Open carry, for handguns, is really stupid too.

I don't believe your post to be sincere nor do I believe you actually..."made a point", but I'll play along.

I am not the arbiter of who is and is not mentally ill.  Although it's an imperfect system, we have to rely on medical professionals and the courts for that.  There is a spectrum of mental illness and I don't belive it should all be treated the same.

PTSD and Paranoid Schitzophrenia are not the same yet are both forms of mental illness.  Limiting any person's constitutional rights is something that I don't take lightly and I think every benefit of the doubt should be afforded to a law abiding citizen.

How strict should a background check be? Already have to wait 10 days to "cool down" even though I might own several guns already. What gun show loophole are you talking about? Out here in CA it's illegal to sell a firearm without going through an FFL, so there is no gun show loophole, it's a bullshit scare tactic blown up by politicians, same with stricter background checks.
